 Contribution to the UN (General Comment 25)

We participated in the second public consultation promoted by the Committee on the Rights of the Children in November 2020, to contribute to the text of United Nations (UN) Children’s rights in relation to the digital environment. The text submitted by the Data Privacy Research Association focused on the privacy and personal data protection chapter (“the right to privacy”). The comments had as object (i) profiling techniques directed to children; (ii) the identification of the best interest of the child in the processing of their data; (iii) the clarity and transparency for parental consent; and (iv) the intersection between data processing and commercial exploitation of children. Our suggestions were based on the Brazilian legal experience, on the FederalConstitution, the Statute of children and adolescents (ECA) and the Brazilian General Data Protection Statute
