 Advocacy Paper: Multijurisdictional Analysis of Data Driven Mergers: Current Diagnosis and Public Policy Proposals for Brazil,

On May, 2021, the Association released an unprecedented study on data driven mergers of two or more companies that were previously independent and with business models based on the economic exploitation of personal data. The research, entitled Multijurisdictional Analysis of Data Driven Mergers: Current Diagnosis and Public Policy Proposals for Brazil, was produced by Lucas Griebeler (University of Chicago), presents recommendations for the Administrative Council for Economic Defense (Cade) to address acquisitions oriented to the economic exploitation of personal data, an emerging theme in contemporary competition law, based on dialogue with the Authority National Protection of Personal Data (ANPD). In a nutshell, the project seeks to build awareness to the thesis that the review of mergers and acquisitions should include privacy in the way it impacts quality and prices and,  ultimately, consumer welfare. Privacy should not be excluded for a full and comprehensive economic review. The project is also dedicated to the debate of the limits of antitrust law, presented by the University of Chicago’s Stigler Report in 2019
